These Terms and Conditions regulate access to and use of the Med Jobs Australia platform, recruitment services, AI matching tools, candidate databases, employer dashboards and related workforce technology services.

By accessing or using the Platform, you agree to be bound by these Terms and Conditions. If you do not agree with these Terms, you must not access or use the Platform.

Introduction

Welcome to Med Jobs Australia.

These Terms and Conditions regulate your access to and use of the Med Jobs Australia websites, recruitment services, apps, workforce intelligence services, artificial intelligence matching services, candidate databases, employer dashboards, job advertising services and other related services.

By accessing or using the Platform, you agree to be bound by these Terms and Conditions. If you do not agree with these Terms, you must not access or use the Platform.

These Terms apply to all users of the Platform, including healthcare professionals, job applicants, employers, clinics, hospitals, corporate healthcare groups, recruitment agencies, locum providers, contractors, government health services, education providers and other organisations.

Med Jobs Australia operates in the Australian healthcare, recruitment and workforce technology sector. Users are expected to comply with all applicable Australian laws, including privacy, employment, workplace relations, healthcare registration, consumer protection, anti-discrimination, migration, labour-hire, intellectual property and data protection laws.

Med Jobs Australia acts as a facilitator of employment and workforce opportunities only. Unless expressly stated in a separate written agreement, Med Jobs Australia is not:

an employer;

a labour-hire provider;

a migration agent;

a registered training organisation;

a registered health practitioner regulator;

a professional indemnity adviser;

an employment law adviser;

a contracting party to any employment relationship;

responsible for final recruitment, hiring, credentialing or employment decisions.

Employers and candidates remain responsible for independently verifying the suitability, qualifications, registration status, employment conditions, work rights and compliance obligations relevant to any role.

Australian Regulatory Framework

Users acknowledge that healthcare recruitment in Australia may involve obligations under Commonwealth, state and territory laws, including but not limited to:

Privacy Act 1988 (Cth) and the Australian Privacy Principles, where applicable;

Fair Work Act 2009 (Cth);

National Employment Standards;

applicable modern awards and enterprise agreements;

workplace health and safety laws;

anti-discrimination and equal opportunity laws;

Australian Consumer Law;

migration and visa laws;

health practitioner registration requirements;

professional board codes and standards;

state and territory labour-hire licensing laws where applicable;

mandatory reporting and professional conduct obligations;

record keeping, taxation and superannuation obligations;

applicable health service credentialing and clinical governance requirements.

The Privacy Act includes 13 Australian Privacy Principles applying to many private sector organisations and Australian Government agencies, and the OAIC states that breaches of the APPs may lead to regulatory action and penalties.

Employers using the Platform must ensure their employment practices comply with Australian workplace laws. The Fair Work Ombudsman identifies the National Employment Standards as minimum employment entitlements for Australian employees.

Healthcare employers and candidates should also use the Ahpra public register where applicable to check whether a practitioner is registered and to review current registration status.

Eligibility

To access and use the Platform, you must be at least 18 years of age and have legal capacity to enter into legally binding agreements.

By registering an account or using our services, you represent and warrant that:

all information you provide is true, accurate, current and complete;

you have authority to act on behalf of any organisation you represent;

you will comply with all applicable laws and professional obligations;

you will not use the Platform for unlawful, misleading, discriminatory or fraudulent purposes.

Healthcare professionals are solely responsible for ensuring that their registration, licence, certification, qualifications, work authorisation, visa status, employment history and professional information remain accurate and current.

Employers are responsible for ensuring that job advertisements, role requirements, pay information, employment conditions and recruitment processes comply with applicable Australian laws.

If any eligibility or compliance requirement is not met, Med Jobs Australia may restrict, suspend or terminate access to the Platform.

User Accounts

Certain parts of the Platform require users to create an account.

You are responsible for:

maintaining confidentiality of your login details;

ensuring account information remains accurate;

all activity that occurs through your account;

immediately notifying us of unauthorised access, suspected compromise or misuse.

You must not share your account with another person or organisation unless expressly authorised by Med Jobs Australia.

Med Jobs Australia may suspend, restrict or terminate an account where we reasonably believe that:

the account has been misused;

information is false, misleading or incomplete;

there is a security concern;

the user has breached these Terms;

the account is being used for unlawful, discriminatory, fraudulent or harmful activity.

Candidate Responsibilities

Healthcare professionals and candidates using the Platform must provide truthful, accurate, current and complete information in their profiles, resumes, applications, documents, qualifications and communications.

Candidates must not misrepresent:

identity;

qualifications;

clinical experience;

health practitioner registration status;

Ahpra registration number;

specialist recognition;

supervision level;

Medicare provider number eligibility;

visa status;

work rights;

employment history;

referee details;

criminal history checks;

working with children checks;

immunisation status;

mandatory training;

professional indemnity cover;

procedural competence;

rural or hospital experience;

availability;

willingness to relocate;

any other material information relevant to employment.

Candidates are responsible for ensuring that any professional claims made through the Platform are accurate and verifiable.

Candidates acknowledge that healthcare employers may rely on information provided through the Platform when deciding whether to interview, shortlist, employ, contract or engage a candidate.

Providing false, misleading or incomplete information may result in account suspension, removal from consideration for opportunities, notification to relevant employers, and where legally required or appropriate, notification to relevant authorities.

Employer Responsibilities

Employers using Med Jobs Australia agree to use the Platform only for legitimate recruitment, workforce planning and related business purposes.

Employers must ensure that all job advertisements, position descriptions, employment opportunities, salary information, workforce requirements and recruitment communications are accurate, lawful, current and not misleading.

Employers are responsible for complying with all applicable Australian laws, including:

Fair Work Act obligations;

National Employment Standards;

applicable awards and enterprise agreements;

workplace health and safety laws;

anti-discrimination and equal opportunity laws;

privacy laws;

healthcare credentialing requirements;

Ahpra and professional board requirements;

migration and work rights obligations;

superannuation, tax and payroll obligations;

labour-hire licensing laws where applicable;

state and territory employment and health service laws.

Employers must not publish job advertisements or use recruitment practices that are discriminatory on the basis of protected attributes such as race, sex, age, disability, pregnancy, family responsibilities, religion, political opinion, national extraction, social origin, gender identity, sexual orientation or other protected attributes under applicable laws.

The Australian Human Rights Commission states that discrimination laws apply in public and private sector employment, and recruitment agencies and employers must take care not to discriminate in recruitment processes.

Employers must conduct their own due diligence before making any offer, including:

registration checks;

reference checks;

identity checks;

work rights checks;

qualifications verification;

clinical credentialing;

police checks where relevant;

working with children checks where relevant;

health service compliance checks;

scope of practice review;

supervision requirements;

Medicare, provider number or billing eligibility checks where relevant.

Med Jobs Australia does not participate in final hiring decisions and does not guarantee the suitability, competence, registration status, performance, conduct, availability or ongoing compliance of any candidate.

Healthcare Registration and Professional Compliance

Healthcare professionals remain solely responsible for maintaining all professional registrations, licences, certifications and professional obligations relevant to their profession.

This may include, where applicable:

Ahpra registration;

specialist college recognition;

Medicare provider number eligibility;

professional indemnity insurance;

CPD requirements;

recency of practice requirements;

supervision requirements;

English language requirements;

criminal history checks;

working with children checks;

immunisation requirements;

mandatory reporting obligations;

compliance with professional codes of conduct;

compliance with scope of practice requirements.

Med Jobs Australia may request verification of professional registrations, licences, qualifications, certifications, identity documents, work rights, employment history and other relevant credentials.

Any verification activities performed by Med Jobs Australia are preliminary and do not guarantee:

professional competence;

suitability for employment;

current registration status;

scope of practice;

clinical safety;

eligibility for a specific role;

compliance with employer requirements;

successful credentialing by a health service.

Employers should independently verify practitioner registration through the official Ahpra register where applicable. Ahpra states that it registers health practitioners in Australia and publishes registers that allow users to check registration status.

International Candidates

International healthcare professionals using the Platform are responsible for ensuring that they meet all applicable Australian registration, visa, immigration, work rights, English language, qualification recognition and professional requirements.

Med Jobs Australia does not guarantee:

Ahpra registration approval;

specialist college recognition;

visa approval;

employer sponsorship;

employment offers;

relocation support;

credential recognition;

supervision approval;

Medicare provider number eligibility;

successful placement outcomes.

Med Jobs Australia is not a registered migration agent and does not provide immigration advice. Any information about visa pathways, registration pathways or employment eligibility is general information only and must not be relied on as legal, migration, employment or professional advice.

Candidates should seek independent advice from appropriately qualified professionals, including registered migration agents, lawyers, colleges, Ahpra, specialist medical colleges, employers or relevant government agencies.

Labour Hire, Locum and Contractor Arrangements

Med Jobs Australia is a technology and recruitment facilitation platform. Unless expressly agreed in a separate written agreement, Med Jobs Australia does not supply workers as a labour-hire provider and does not employ, supervise, direct or pay candidates on behalf of employers.

Where an employer, recruitment agency, locum agency or other organisation uses the Platform for labour-hire, locum or contractor arrangements, that organisation is responsible for ensuring compliance with all applicable labour-hire licensing laws.

Some Australian jurisdictions require labour-hire providers to hold a licence. Queensland’s labour-hire licensing scheme is mandatory for labour-hire providers operating in Queensland, and users of labour-hire services may only use licensed providers. Victoria’s Labour Hire Authority states that licence applications assess a business’s capacity to comply with the Labour Hire Licensing Act 2018 (Vic). South Australia has also expanded labour-hire licensing requirements, with licensing obligations applying to labour-hire providers under its reforms.

Employers and agencies must also ensure that worker classification is lawful. The Fair Work Ombudsman states that sham contracting can occur where an employee is incorrectly told they are a contractor.

Med Jobs Australia is not responsible for determining whether a role is employment, contracting, consulting, locum, agency, labour-hire or another arrangement. Employers, agencies and candidates must obtain their own advice where required.

AI-Powered Workforce Intelligence

Med Jobs Australia may use artificial intelligence, machine learning, predictive analytics, automation technologies and workforce intelligence systems to improve recruitment outcomes and user experience.

These tools may assist with:

candidate recommendations;

job matching;

clinical-fit matching;

workforce demand analysis;

career benchmarking;

salary benchmarking;

employer recommendations;

application ranking support;

recruitment workflow automation;

workforce planning insights;

job advertisement optimisation.

AI-generated outputs are decision-support tools only. They may contain inaccuracies, assumptions, omissions, bias, outdated information or incomplete analysis.

AI outputs must not be treated as:

legal advice;

migration advice;

employment advice;

clinical advice;

financial advice;

credentialing advice;

professional regulatory advice;

a guarantee of candidate suitability;

a guarantee of employment outcomes;

a substitute for human review.

Employers remain responsible for making lawful, fair, human-reviewed recruitment decisions. Candidates remain responsible for reviewing opportunities independently and ensuring the accuracy of information they submit.

Med Jobs Australia may review, test and improve AI systems to reduce bias, improve accuracy and enhance compliance. However, no AI system can guarantee perfect accuracy or fairness.

Users must not rely solely on automated recommendations when making employment, hiring, credentialing, visa, registration or clinical workforce decisions.

Anti-Discrimination, Equal Opportunity and Fair Recruitment

Users must not use the Platform in a way that unlawfully discriminates against, harasses, excludes or disadvantages any person.

Employers must ensure that job advertisements, screening criteria, interview questions, shortlisting processes and selection decisions are based on genuine occupational requirements and lawful role criteria.

Users must not request or use information in a way that unlawfully discriminates on the basis of protected attributes, including:

age;

disability;

race;

colour;

national or ethnic origin;

sex;

pregnancy;

breastfeeding;

marital or relationship status;

family or carer responsibilities;

sexual orientation;

gender identity;

intersex status;

religion;

political opinion;

social origin;

medical condition where protected;

union activity;

other attributes protected by applicable law.

Where a role has genuine occupational requirements, rural workforce requirements, cultural safety requirements, Aboriginal and Torres Strait Islander health service requirements, language requirements or other specific criteria, employers are responsible for ensuring such criteria are lawful, proportionate and properly documented.

Job Advertisements and Salary Information

Employers must ensure that job advertisements are accurate, current and not misleading.

Job advertisements should clearly state, where applicable:

employer name;

location;

role type;

employment type;

full-time, part-time, casual, locum or contractor status;

salary or remuneration range where provided;

billing arrangements where relevant;

award or enterprise agreement coverage where relevant;

supervision requirements;

registration requirements;

visa or work rights requirements;

expected duties;

required qualifications;

mandatory checks;

on-call obligations;

after-hours expectations;

rural or remote requirements;

relocation support where applicable;

closing date where applicable.

Employers must not advertise roles that are false, misleading, expired, unavailable, discriminatory or designed primarily to collect candidate information without a genuine recruitment purpose.

Under the Australian Consumer Law, businesses must avoid misleading or deceptive conduct. The ACCC provides guidance and enforcement on misleading business conduct and consumer representations.

Med Jobs Australia may remove or edit job advertisements that appear inaccurate, misleading, unlawful, discriminatory, outdated or inconsistent with these Terms.

Recruitment Services Disclaimer

Med Jobs Australia is a portal and technology platform designed to assist healthcare professionals and healthcare employers to connect.

We do not guarantee:

job placement;

interview invitations;

employer responses;

candidate responses;

successful recruitment;

candidate retention;

employment suitability;

clinical performance;

credentialing outcomes;

visa or registration outcomes;

salary outcomes;

workforce results;

quality of employer or candidate conduct.

Employers and candidates are responsible for conducting their own due diligence before entering into employment, contracting, consulting, locum or professional engagements.

Privacy and Data Protection

Personal information collected, used, disclosed, stored and processed through the Platform is governed by our Privacy Policy.

By accessing or using the Platform, you agree that your personal information will be handled in accordance with our Privacy Policy and applicable Australian privacy legislation.

Depending on the nature of the information collected, Med Jobs Australia may collect and process personal information including:

identity information;

contact details;

employment history;

resume information;

qualifications;

registration details;

work rights information;

location preferences;

salary expectations;

profile data;

application data;

employer communications;

usage analytics;

technical data;

verification information.

Some information about healthcare professionals may constitute sensitive information under Australian privacy law, including health information, professional disciplinary information, criminal history information or certain identity verification information. Sensitive information will be handled in accordance with applicable law and our Privacy Policy.

The OAIC states that the Privacy Act regulates the handling of personal information and gives individuals greater control over how their personal information is handled.

While we implement reasonable security measures, no online platform can guarantee absolute security.

Data Breaches and Security Incidents

Med Jobs Australia will take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure.

Where required by law, Med Jobs Australia will comply with applicable data breach notification obligations.

The OAIC is Australia’s independent national regulator for privacy and freedom of information and provides pathways to report data breaches and make privacy complaints.

Users must notify Med Jobs Australia immediately if they become aware of:

unauthorised account access;

data misuse;

suspected privacy breach;

incorrect disclosure of candidate or employer information;

cyber security incident;

misuse of login credentials.

Employer Access to Candidate Information

Employers must only use candidate information for legitimate recruitment, workforce planning and employment-related purposes.

Employers must not:

sell candidate information;

use candidate information for unrelated marketing;

disclose candidate information to unauthorised third parties;

retain candidate information longer than necessary;

use candidate information for discriminatory purposes;

contact candidates in a misleading, harassing or unlawful manner;

scrape, download or copy candidate data for unauthorised use.

Employers are responsible for handling candidate information in accordance with applicable privacy laws and their own privacy obligations.

Intellectual Property

All materials, content, software, technology, algorithms, workforce intelligence systems, databases, AI technologies, brands, logos, designs, features and functionalities of the Platform are owned by Med Jobs Australia or its licensors.

Users must not:

copy;

reproduce;

modify;

distribute;

scrape;

reverse engineer;

data mine;

publish;

sell;

commercially exploit;

create derivative works from;

interfere with;

bypass access controls relating to;

any part of the Platform without written consent.

Any suggestions, feedback, recommendations or ideas submitted to Med Jobs Australia may be used by us without compensation, restriction or obligation, unless otherwise agreed in writing.

User Content

Users may submit content to the Platform, including profiles, resumes, job advertisements, messages, documents, comments, applications and other materials.

By submitting content, you grant Med Jobs Australia a non-exclusive, royalty-free, worldwide licence to use, host, store, reproduce, display, modify, process and transmit that content for the purpose of operating, improving and providing the Platform.

You represent and warrant that:

you have the right to submit the content;

the content is accurate and lawful;

the content does not infringe third-party rights;

the content is not defamatory, discriminatory, misleading, offensive or unlawful;

the content does not contain malware or harmful code.

Med Jobs Australia may remove or restrict content that breaches these Terms or may expose users, employers, candidates or Med Jobs Australia to risk.

Acceptable Use

Users must use the Platform responsibly, lawfully and in accordance with its intended purpose.

Users must not:

provide false, misleading or fraudulent information;

misrepresent qualifications, registrations, work rights or employment history;

impersonate another individual or organisation;

upload unlawful, offensive, defamatory, discriminatory or misleading content;

interfere with Platform operations, security or performance;

attempt unauthorised access to systems, databases or user accounts;

upload malware, viruses or malicious software;

use bots, scraping tools, automated extraction systems or similar technologies without written consent;

harvest candidate or employer data;

use the Platform for spam, phishing or unsolicited marketing;

use the Platform to facilitate unlawful employment arrangements;

use the Platform to discriminate unlawfully;

bypass payment obligations;

manipulate ratings, metrics, analytics or matching systems;

use the Platform for unlawful, fraudulent or unauthorised activities.

We reserve the right to investigate suspected violations and take appropriate action where necessary.

Fees, Subscriptions and Paid Services

Some services may be free, while others may require payment, subscription, package purchase or separate commercial agreement.

Paid services may include:

job advertisement packages;

employer subscriptions;

featured listings;

recruitment marketing packages;

candidate database access;

AI workforce intelligence tools;

shortlisting support;

employer branding services;

analytics dashboards;

other premium services.

Fees, payment terms, inclusions, exclusions, cancellation rights and refund conditions will be displayed on the Platform or set out in a separate agreement.

Unless otherwise stated, fees are in Australian dollars and may be subject to GST.

Med Jobs Australia may change pricing, packages or service inclusions from time to time. Changes will not affect services already paid for unless permitted by law or agreed in writing.

Refunds and Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any rights that cannot be excluded under the Australian Consumer Law.

Where services come with guarantees under Australian Consumer Law, those guarantees will apply to the extent required by law.

To the extent permitted by law, refunds for paid services will be handled in accordance with the refund terms displayed at the time of purchase or in the relevant service agreement.

Med Jobs Australia does not provide refunds for failure to secure employment, failure to recruit a candidate, lack of employer responses, lack of candidate responses or user change of mind, unless required by law or expressly agreed in writing.

Service Availability

We aim to provide reliable access to the Platform. However, we do not guarantee uninterrupted availability.

Access may be restricted or interrupted due to:

maintenance;

upgrades;

technical failures;

security incidents;

third-party service interruptions;

hosting provider issues;

data centre issues;

cyber incidents;

changes to law;

circumstances beyond our reasonable control.

Med Jobs Australia is not liable for losses arising from temporary interruptions, delays, errors, downtime or system unavailability, to the extent permitted by law.

Account Suspension and Termination

We may restrict, suspend or terminate accounts where we reasonably believe that a user has:

breached these Terms;

provided false, misleading or incomplete information;

engaged in unlawful conduct;

misused candidate or employer data;

compromised Platform security;

engaged in discriminatory recruitment practices;

breached payment obligations;

infringed intellectual property rights;

harmed or risked harm to users, employers, candidates, healthcare organisations or the Platform.

Users may request account closure at any time.

Termination does not affect rights, obligations, liabilities or provisions intended to survive termination, including intellectual property, privacy, payment, indemnity, limitation of liability and dispute resolution provisions.

Disclaimer

Med Jobs Australia provides a healthcare recruitment platform and workforce technology service only.

We do not:

employ candidates;

make recruitment decisions;

guarantee employment outcomes;

guarantee recruitment outcomes;

guarantee candidate suitability;

provide legal advice;

provide migration advice;

provide financial advice;

provide clinical advice;

provide employment law advice;

provide professional registration advice;

guarantee accuracy of AI outputs;

guarantee accuracy of employer or candidate information supplied by users.

Information, workforce insights, benchmarking information, salary information, analytics, candidate recommendations and recruitment suggestions are provided for general informational purposes only.

Services are provided “as is” and “as available” to the maximum extent permitted by law.

Limitation of Liability

To the maximum extent permitted by law, Med Jobs Australia will not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive or economic loss arising from use of, or inability to use, the Platform.

This includes loss arising from:

missed employment opportunities;

failed recruitment;

unsuitable candidates;

unsuitable employers;

business interruption;

loss of income;

loss of profit;

reputational damage;

workforce-related decisions;

AI-generated recommendations;

incorrect user-submitted information;

data loss;

system interruption;

third-party conduct;

regulatory non-compliance by users.

Where liability cannot be excluded by law, our liability will be limited to the maximum extent permitted by law, including, where applicable, resupply of services or the cost of resupply.

Indemnity

You agree to indemnify and hold harmless Med Jobs Australia, its officers, directors, employees, contractors, agents, related entities and service providers from and against any claim, demand, loss, liability, damage, cost or expense arising out of or related to:

your use of the Platform;

your breach of these Terms;

your breach of law;

your uploaded content;

your recruitment practices;

your employment decisions;

your candidate screening processes;

your misrepresentation of qualifications, registration, experience or work rights;

your misuse of personal information;

your infringement of third-party rights;

your unlawful or discriminatory conduct.

Dispute Resolution

Before commencing legal proceedings, a party must notify the other party in writing of the dispute and provide reasonable details.

The parties agree to attempt to resolve the dispute in good faith through negotiation.

If the dispute cannot be resolved within a reasonable period, either party may pursue available legal remedies.

Nothing in this clause prevents a party from seeking urgent injunctive relief or taking action required by law.

Changes to These Terms

These Terms may be amended from time to time due to changes in our services, technology, legal obligations, commercial arrangements or Platform operations.

Updated Terms will be posted on the Platform and will take effect from the date of posting unless otherwise specified.

Continued use of the Platform after updated Terms are posted constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of New South Wales, Australia, unless another jurisdiction is specified in a separate written agreement.

The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth courts of Australia.

For users located outside New South Wales, additional state, territory or Commonwealth laws may apply depending on the nature of the services, the location of the employer, the location of the candidate and the place where work is performed.
